OPTO Foresight Subscription Terms and Conditions

Introduction

1. These terms and conditions ("Opto Foresight Subscription Terms") form the basis of the opportunity to participate in the CMC Markets Investments Limited offer (“Opto Foresight Subscription Offer").

2. Taking part in this Opto Foresight Subscription Offer constitutes acceptance of these Opto Foresight Subscription Terms. CMC Markets Investments Limited (Company Registration Number 12816952) (“CMC Invest”) is the provider of this Opto Foresight Subscription Offer. CMC Invest is authorised and regulated by the Financial Conduct Authority (registration number 948126). CMC Invest reserves the right to withdraw the Opto Foresight Subscription Offer, or vary or cancel any of these Opto Foresight Subscription Terms at any time, in its sole discretion and without prior notice, subject to Applicable Law.

3. Capitalised terms used but not defined herein shall have the meaning given to them in the CMC Invest General Terms of Business (as amended from time to time).

Conditions of Eligibility

4. The Opto Foresight Subscription Offer is available to customers who have satisfied the eligibility criteria (see below) ("Eligible Customer").

5. The eligibility criteria for the Opto Foresight Subscription Offer are that the Eligible Customer must open and/or switch their existing plan to a Premium plan with CMC Invest. Existing CMC Invest customers who are already on our Premium plan are eligible to participate in the Opto Foresight Subscription Offer.

Offer Period

6. The Opto Foresight Subscription Offer is available from 1 August 2025 and may be cancelled or otherwise varied by CMC Invest at any time, without prior notice.

The Opto Foresight Subscription Offer

7. The Opto Foresight Subscription Offer entitles an Eligible Customer to receive via email a complimentary subscription to OPTO Foresight facilitated by Substack Inc. (the “Subscription”) within five (5) Business Days of the Eligible Customer accepting any additional terms required to access the Subscription.

8. Participation in the Opto Foresight Subscription Offer may involve participants agreeing to third-party terms, such as those independently set by Substack Inc. (including its Terms of Use, Information Collection Notice, and Privacy Policy).

9. If an Eligible Customer switches plans from a Premium plan they will no longer be able to participate in the Opto Foresight Subscription Offer and their access to the Subscription will be revoked.

Legal

10. CMC Invest will not be liable to an Eligible Customer in relation to this Opto Foresight Subscription Offer (including for any losses arising as a result of participating in this Opto Foresight Subscription Offer) and the provisions of clause 21 ("Our liability towards you, and limitations of that liability") of the General Terms shall apply to this Opto Foresight Subscription Offer as if set out here in full.

11. CMC Invest collects personal information from all participants in order to conduct the Opto Foresight Subscription Offer which involves CMC Invest providing Substack Inc., with a participants email address to receive the Subscription. If any information requested by CMC Invest is not provided by the participant, the participant may not be able to participate in the Opto Foresight Subscription Offer. Information collected from participants in the Opto Foresight Subscription Offer is subject to the CMC Invest Privacy Policy (as amended from time to time) and will be handled in accordance with Applicable Law.

12. In addition to any other rights and remedies available to CMC Invest, in the case of any breach or suspected breach of these Terms, CMC Invest is entitled to deem an Account ineligible for the Opto Foresight Subscription Terms.

13. The Subscription is non-transferable and has no cash alternative and is limited to one Subscription per Eligible Customer.

14. These Opto Foresight Subscription Terms and any non-contractual obligations arising out of or in connection with these Opto Foresight Subscription Terms are governed by and interpreted in accordance with, the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to hear all and any disputes or claims (including non-contractual disputes or claims) arising out of or in connection with these Opto Foresight Subscription Terms.

15. CMC Invest does not provide investment advice and individual investors should make their own decisions or seek independent advice. The value of investments can go up as well as down and you may receive back less than your original investment.
