CMC Markets Singapore Pte. Ltd. (“CMC”), which operates the CMC Invest platform, is committed to protecting the privacy of all personal data and other information that we obtain from you. The CMC Invest platform allows Clients to buy, hold and sell shares, ETFs and other selected products across a wide range of global markets, including but not limited to Singapore, the U.S, the UK, Hong Kong and Japan. Our Privacy Policy explains in a transparent and trusted manner, how and why we collect personal data and other information about you, and how that personal data and information is maintained and used (“Privacy Policy”). “Personal data” has the meaning set out in the Personal Data Protection Act 2012, as amended from time to time (“PDPA”). In providing our Investment Products and Services to you, we will require you to disclose certain personal data to us. Capitalised terms used but not defined in this Privacy Policy have the meanings given to them in the CMC Invest Platform General Terms and Conditions.

What personal data and information are we collecting and how are we collecting it?

We will collect and process the following personal data and information about you:

• Personal data and information you provide to us

You provide us with personal data by filling in the application or other forms on our website, the iOS or Android application (Apps) or the CMC Invest platform, by accessing and trading on your Trading Account through the CMC Invest platform or by corresponding with us by phone, email or otherwise. The personal data and other information you provide us may include your name, email address, physical address, postal code, home and mobile phone numbers, contact details, financial information about your income and wealth, identification information such as NRIC (National Registration ID Card) for citizens and permanent residents, and FIN (Foreign Identification Number) for residing and working foreigners, Taxpayer Identification Number (TIN), date of birth, IP address, device ID, MAC address, professional and employment details, records of Investment Products and Services you’ve obtained or applied for, trading history and other analogous personal data.

• Information we collect about you

  We will also collect information about you through your use of this website, the iOS or Android application (Apps) and the CMC Invest platform. This information may include site areas visited, pages viewed, frequency and duration of visits.

• Personal data and information we receive from other sources

  We may also collect your personal data from third parties, including, for example, business partners, analytics providers, search information providers, credit reference agencies and third-party marketing companies or through publicly available sources.

• Monitoring of communications

  Subject to applicable laws, we will monitor and record your calls, emails, text messages, app and digital communications, social media messages and other communications in relation to your dealings with us. We will do this for regulatory compliance, crime prevention and detection purposes, to protect the security of our communications systems and procedures, for quality control and staff training, and so we can provide you with a record of what’s been said when you request for such records. We will also monitor activities on your Trading Account where necessary for these reasons and this is justified by our legitimate interests or our legal obligations.

Why we collect your personal data and information

CMC collects your personal data in order to provide you with our Investment Products and Services, to establish and manage your Trading Account and to comply with applicable laws. By collecting your personal data, CMC is able to monitor and improve the Services we offer to our existing and potential clients.

How we use your personal data and information

CMC may use your personal data for one or more of the following purposes:

• To provide the Services to you that you have requested including processing transactions, and customer support;
• To verify your identity when you contact us;
• To conduct security operations such as using your IP address to verify your identity when you log on to your Trading Account;
• To carry out fraud prevention checks;
• To maintain your personal profile and manage your Trading Account;
• To contact you when necessary or appropriate in relation to the Services being provided to you;
• To keep you updated while you are a Client in relation to matters such as your trading or investment activities;
• To manage and administer the Investment Products and Services provided to you;
• To effect purchases and sales of Investment Products and the transfer of funds and payments;
• To provide you with information regarding the Investment Products and Services offered by CMC;
• To develop an understanding of the Investment Products and Services that you may be interested in obtaining from CMC;
• To provide you with information or opportunities that we believe may be relevant to you (including but not limited to new product announcements, market updates, upcoming webinars and other relevant information relating to the Services). In instances where we send you marketing communications, this will be done only with your prior consent or where permitted in accordance with applicable data protection regulations;
• To tailor the website, the iOS and Android application (Apps), or other services we provide to you to meet your needs and interests;
• To address and investigate any complaints, claims or disputes;
• To conduct credit checks (including but not limited to providing your name and credit rating to the relevant banks or credit reporting agencies);
• To conduct screenings or due diligence checks as may be required under applicable law, regulations or directives; and
• To create anonymised statistical data, we may share anonymised data with other companies; however, this data will not include any information that personally identifies you.

'Do Not Call' provisions

From time to time, CMC may contact you via call or SMS to inform you about our Investment Products and Services.

If you have previously consented to receiving marketing and/or promotional messages, we will continue to send you such messages until you withdraw your consent. If you no longer wish to receive marketing and/or promotional messages, please contact us at dpo@cmcmarkets.com.

Pursuant to Part XI of the PDPA, please note that your personal data may be used by us to send you marketing and/or promotional messages. We will not send you marketing and/or promotional messages to the telephone number(s) you have registered with the Do Not Call Registry.

Disclosure and sharing of personal data

• To any related corporation of CMC from time to time (including but not limited to for purposes of centralization of operations within CMC’s group, and for purposes in connection with business planning, restructuring and strategy);
• To third party suppliers and agents (including banks, financial services providers and professional advisers) who perform services for and on behalf of CMC and process Clients’ personal data strictly in accordance with our instructions;
• To persons acting in a representative, fiduciary or attorney capacity in relation to a Client’s Trading Account;
• To any person having a legal or beneficial interest in relation to a Client’s Trading Account;
• Where such disclosure is reasonably necessary to prevent actual or potential breaches of law and/or inappropriate use of our Investment Products and Services; or
• To comply with applicable laws, court or government orders, stock exchange rules or regulatory requirements.

Retention of personal data

Your personal data is held for as long as the purpose for which it was collected remains and until retention is no longer necessary for business purposes or legal requirements.

Protection of personal data

Reasonable procedures have been implemented to ensure CMC protects Client’s personal data. These include procedural, physical and electronic safeguards. Notwithstanding the foregoing, we cannot guarantee the security of personal data transmitted via the Internet and you should install anti-virus software when transmitting personal data to us or receiving personal data from us.

Accuracy of personal data

To ensure that CMC holds accurate and current information, we ask that you promptly notify us of any changes to the personal data we hold about them.

Access to and correction of personal data

You may request access to the personal data that we hold about you and request that we correct any personal data that is inaccurate or incomplete, subject to the exceptions under the PDPA and other applicable laws.

Requests for access to or correction of your personal data should be submitted to our Data Protection Officer at dpo@cmcmarkets.com. We may charge an administrative fee to process an access request. If a fee is payable, we will inform you of the fee before processing your request.

How we protect your information in data transfers

We may transfer personal data to other countries outside of Singapore. Where we do so, we will ensure that the recipient is bound by legally enforceable obligations to provide a standard of protection for the personal data that is comparable to the protection provided under the PDPA, including through appropriate contractual, legal or other safeguards.

AI is used to support our employees and business processes and is not used as the sole basis for making decisions that have a significant effect on individuals unless permitted or required under applicable laws. Where appropriate, decisions supported by AI are subject to appropriate human oversight and review.

CMC will review this Privacy Policy from time to time and may make changes at any time without prior written notice. Amendments to this Privacy Policy will be effective from the time they are posted on our website and your continued use of this website will constitute acceptance of any amendments to this Privacy Policy.
